Found liable as operator; appealing ruling to Sixth Circuit
A federal judge ordered DTE Energy and its subsidiaries to pay $100 million for sulfur dioxide pollution from the Zug Island coke plant near Detroit. The February ruling found DTE liable as an operator of the facility, even though EES Coke Battery has no employees of its own. DTE appealed. In July, Judge Gershwin Drain refused to pause compliance while the appeal is pending, so the facility must obtain new pollution permits by November 1.
