Issued the 2-1 ruling in Pawnee Nation v. Zeldin

The Tenth Circuit ruled 2-1 on Oct. 16 that Oklahoma can run federal environmental programs on tribal lands, rejecting the Pawnee Nation's challenge. The decision leaves state agencies, not tribal governments, as the main regulators for air and waste permits in much of eastern Oklahoma.

Hearing Kalshi's appeal of the Utah ruling

Utah can keep enforcing its ban on sports-style prediction bets while Kalshi appeals. The 10th Circuit refused on September 8 to pause the state's prop betting law, and last week a Sixth Circuit panel rejected the same preemption argument in Ohio and Tennessee.
