Repeal of Prohibition and the 21st Amendment (1933)
The 21st Amendment ended the nationwide ban on alcohol and gave each state the power to control alcohol sales within its borders. Virginia, like other states, created its own licensing agency rather than let sales go unregulated.
States set up ABC-style agencies to license everyone who produces, wholesales, or retails alcohol.
Anyone selling alcohol in Virginia must hold a state-issued license, which is why a restaurant needs an ABC permit before serving drinks.
The Virginia ABC license issued to House of Diemonds exists because of this 1933 arrangement. State control, not federal law, sets the terms for when and where alcohol can be sold.
